PRIVACY AND REGULATORY COMPLIANCE

QUALIFICATION SUMMARY

  • An 11 year post-call barrister and solicitor in privacy and freedom of information law, with a specialty practice in privacy compliance for federal and provincial privacy regimes, PIPEDA, PHIPA, and FIPPA. Concurrent practice focus in Contract, Information Technology and Intellectual Property laws in regulatory and commercial frameworks.
  • Currently completing contract with Canadian Primary Care Sentinel Surveillance Network (CPCSSN) directing all on-going activities related to the development, implementation, and maintenance of privacy and information system security protocols, working with multi-disciplinary teams of experts in information technology, network security, research and project management for Canada’s first pan-Canadian electronic medical records network by primary care research networks, funded by the Public Health Agency of Canada and the College of Family Physicians of Canada.
  • Published several articles on privacy and access to information, as well as speaker on implementing privacy protocols in research and EMR environments Agency for Healthcare Research and Quality – Practice Based Research Network Conference (2012 Washington DC), North American Primary Care Research Group (2012, New Orleans) , Family Health Forum (2012, Toronto), plus several other conferences and organizations such as the Canadian Association of Research Ethics Boards.
  • Founded legal practice specializing in privacy and information system security compliance in 2006, serving small to multi-system private and public organizations – with a particular expertise in privacy and freedom of information compliance for health care providers (community health centres, local health integration networks, long term care facilities, and public health units).
  • Recognized as a compliance “expert” by both Federal and Provincial privacy commissioners for published articles in mainstream media and professional journals. Also extensive speaking and teaching in privacy and related subjects for the University of Western Ontario, Middlesex Law Association, Ivey School of Business, Canadian Bar Association, as well as professional organizations and conferences. Further served as a committee member of the Privacy sections of the Canadian and Ontario Bar Associations.
  • Over a decade of executive management experience prior to being called to the Bar, leading staff, volunteers and consultants in publishing, professional philanthropy, and law, serving as a member of the executive administrative team for two hospitals and a university.

2010 - Current

Research Privacy and Ethics Officer, Canadian Primary Care Sentinel Surveillance
Network, COLLEGE OF FAMILY PHYSICIANS OF CANADA
  • Oversee all privacy and regulatory compliance for pan-Canadian research project involving ten research networks from eight provinces in the creation of a primary care “network of networks” for research of chronic and neurological health conditions from electronic medical records of participating primary care physicians.
  • Designed and conducted privacy impact assessments to meeting privacy compliance legislation in each of the provinces, including Québec. Crafted customized privacy compliance toolkits, including checklist, training manual, and self-auditing protocol incorporating Privacy by Design principles of the Information and Privacy Commissioner/Ontario.
  • Crafted a suite of privacy and information technology security policies and procedures, as well as standard operating procedures, conflict of interest guidelines and protocol, as well as legal support in the review and preparation of data sharing and research agreements, research ethics board applications, third party confidentiality agreements, internal pledges of confidentiality.
